Everyone should know their Miranda rights. They should be known by everyone because in 1963, Ernesto Miranda was accused of two serious crimes. He kidnapped and rape a 18 year old girl in Phoenix Arizona. He was a 23 year old uneducated man so he did not know much about the law or his rights. He was questioned for two hours without an attorney and confessed verbally and he wrote it on paper as well.
Miranda was found guilty of both crimes in the trial. He was not aware that the police who questioned him did not tell him his rights. He had the right to remain silent. Anything he said can and will be held against him in court of law. He did not have to talk about him that made him feel uncomfortable. He also had the right to have an attorney. The Miranda rights have changed many laws and are rights and freedom. These laws were passed by congress. The Miranda warning is one of these laws. It is there to protect the guilty and the innocent. If these were not there, then they would be treated unfairly. The Miranda rights are like a safeguard. This case changed the way people got arrested. Before the Miranda rights people did not get told their rights when being arrested. Now it is a law that is unforced and is a requirement that cannot be changed by Congress.
The Miranda rights dealt with the first 10 amendments. It states in amendment 5 anyone arrested in the United States has certain rights and privileges that should be spelled out for them at the time of arrest. These are here to make sure everyone has the right to due process of the law that states that a person's rights, liberty and property can't be messed with without a trial. If these are violated, then the accuser can't be sentenced.
The Miranda rights are very important when people are being questioned. If you knew them then you would know you have the right to remain silent. Anything you say can and will be used against you in court of law. They have the right to remain silent while being questioned by police. They do not have to talk about anything that might make him or her appear guilty. That's one reason why they're important.
You have more rights than just staying silent. You also have to right to have an attorney when being questioned by police. They should have a lawyer present so the accuser doesn't feel pressured into confessing. When Miranda was being questioned, he was being pressured to make a confession. He did not have a lawyer present. If he or she cannot afford an attorney, one will be provided for them.
That is why Miranda rights are so important. So make sure you remember them. Also make sure you're getting the same rights as everyone else. Don't be like Miranda and mess up. Remember there not just words on paper!
